Understanding the ‘Eligible New Zealand Citizen’ status
Before diving into sponsorship options, it’s crucial to clarify the term Eligible New Zealand Citizen (ENZC).
An ENZC is a New Zealand citizen who was:
- In Australia on 26 February 2001 as the holder of a Special Category Visa (SCV); or
- In Australia for 12 months or more in the two years before 26 February 2001; or
- Assessed as a protected SCV holder before 26 February 2004.
Only an ENZC can sponsor family members for permanent Australian visas. Standard SCV holders who arrived after 26 February 2001 generally do not meet the criteria for sponsorship in the family stream.
Scenarios where a NZ Citizen sponsor may be eligible
1. Partner Visas (Subclass 820/801 and Subclass 309/100)
An ENZC sponsor can sponsor their spouse or de facto partner for a Partner Visa. This includes both the Onshore Partner Visa (Subclass 820/801) – for applicants already in Australia; and the Offshore Partner Visa (Subclass 309/100) – for applicants applying from outside Australia.
If you’re in a genuine and ongoing relationship with a New Zealand citizen who meets ENZC criteria, you may be able to apply for a partner visa leading to permanent residency.
Key tip: If the NZ citizen sponsor is not considered “eligible” under immigration definitions, you may still be able to explore other visa pathways such as the New Zealand Citizen Family Relationship Visa (explained later in this article).
2. Child Visas (Subclass 101 and 802)
Children of an ENZC can be sponsored for a Child Visa, provided they are dependent, under the age limit, and meet health and character requirements. This applies to children born overseas, adopted children, and stepchildren (in certain circumstances).
3. Parent Visas (Subclass 103, 804, 143, 864)
If you are an ENZC living in Australia permanently, you may be able to sponsor your parent for a Parent Visa. This includes Contributory Parent Visas (e.g., Subclass 143 and 864), and Non-contributory Parent Visas (e.g., Subclass 103 and 804).
Note: Parent Visa categories come with long processing times unless you opt for contributory pathways, which require higher application fees but are processed more quickly.
4. New Zealand Citizen Family Relationship Visa (Subclass 461)
This visa is designed for family members of NZ citizens who are not considered “eligible” for sponsorship under other family migration visas.
A Subclass 461 visa allows the non-New Zealand citizen family member of an SCV-holding NZ citizen to live and work in Australia for up to five years, with renewals available.
Who can apply?
A partner (spouse or de facto) or a dependent child or stepchild can apply for this visa.
The NZ citizen, sponsoring the applicant, must hold a Special Category Visa (Subclass 444) and not be an Australian permanent resident or citizen.
This visa is a practical solution when a NZ citizen sponsor does not meet ENZC criteria, but still wishes to bring family to Australia.
